GENERAL

How do you book your cycling vacation with Eye4Cycling?

It is important that you are aware in advance of the details regarding your chosen cycling trip and that you familiarize yourself with Eye4Cycling’s travel conditions.

  • You can book online. You enter everything but ultimately do not have to pay yet.
  • Upon receipt of your booking, we will start reserving the rooms.
  • You will receive confirmation with the invoice within 10 working days.
  • If the booking cannot go through, we will contact you as soon as possible.
  • We recommend that you wait for confirmation from us before purchasing the air/train tickets.
  • Within 8 days of receiving the invoice, remit a deposit of 25% of the total trip cost.
  • At least six weeks before the day of arrival, you must have paid the balance.
  • If you book within six weeks before the day of arrival, you must pay the entire trip price at once.
  • You will receive your travel documents approximately 10 days before your day of arrival.
  • In case you have special requirements, we recommend that you let us know immediately. We will try to accommodate you as best we can.

CYCLING AND HIKING LEVELS

Hhe is very difficult to make an accurate assessment for everyone individually of what is tough or “doable” for someone. Below, therefore, we provide a rough description of what to expect with the various designations regarding the severity of the bicycle trip. Even then, it remains an indication because “hills” or “rolling terrain” can still feel very different.

: light – day hikes in a mainly flat area. Suitable for anyone with some cycling experience.

: light – day hikes in flat and rolling terrain. Suitable for anyone with cycling experience and some basic fitness (100 to 250 altimeters).

: to intermediate – day hikes in a hilly area with small differences in altitude to be covered, interspersed with some tough routes. For participants with reasonable basic fitness (250 to 500 altimeters).

: average – day hikes in a hilly area with short, occasionally tough inclines and/or day hikes with long inclines but not too steep. For participants with good basic fitness (500 to 1000 altimeters).

: more than average – day hikes in a mostly hilly, sometimes mountainous area. The elevations are higher and the slopes are longer than in the previous category. For participants with good cycling fitness.

: strenuous – long day hikes in a hilly and mountainous area with large differences in altitude. For practiced cyclists.

: outer category – long day hikes in a mountainous area with considerable elevation changes. For practiced cyclists.

HISTORY

The heaviness of a hiking trip always depends on your own fitness level, whether you are hiking with or without luggage, the weather and the type of landscape. Below we list our 4 hiking levels for you and briefly explain them.

LEVEL 1: For everyone: walks on well-trodden paths through nearly flat terrain. Above all, the number of miles determines the severity of the hike. Little fitness required for the hike.

LEVEL 2: basic fitness: walks on well-worn trails through flat and hilly terrain. Above all, the number of miles determines the severity of the hike. Light hiking interspersed with some tough day hikes. Good basic fitness required and minor hiking experience desirable.

LEVEL 3: Good fitness: walks on beaten and unbeaten trails, regularly over uneven ground. Hikes in strongly hilly terrain. The mileage and elevation changes each day determine the severity of the hike. Hiking experience and good fitness desirable.

LEVEL 4: Spicy: Spicy hikes through mostly mountainous terrain with significant elevation changes. Sometimes the terrain is difficult. In particular, there are considerable elevation changes. Mountain hiking experience and excellent fitness required.

VZR GARANT

On order to meet its statutory obligation to provide a guarantee, Eye4cycling makes use of the guarantee scheme provided by VZR Garant (www.vzr-garant.nl/en). You can check that this is the case by visiting VZR Garant’s website and verifying that the organisation is listed as a participant. Within the limits of the Guarantee Scheme (found on the VZR Garant website), VZR Garant’s guarantee applies. Garant’s guarantee applies within the limits of its Guarantee Scheme (which can be found on VZR Garant’s website). The Guarantee Scheme specifies the exact (travel) offering to which VZR Garant’s guarantee applies and what the guarantee entails. If services are not provided due to the financial insolvency of Eye4cycling, you can contact VZR Garant, which has its offices at Torenallee 20, 5617 BC Eindhoven, Netherlands, by sending an email toinfo@vzr-garant.nl or +31 (0)85 13 07 630.

THE TRAVEL CLUB

EAs an independent tour operator, ye4cycling is a member of the ZRT “Independent Travel Tour Operator” formula of “The TravelClub.” “Through this formula, “The Travel Club” provides a platform for small-scale specialty tour operators and represents the interests of these organizations.

All members of “The Travel Club” represent a personal approach and are distinguished by their commitment and expertise. They offer a variety of offerings at several diverse destinations, near and far.

All member travel companies have a mandatory travel guarantee on their package tours. This may be with the SGR, GGTO, or with VZR-Garant. Therefore, you are assured at all times that you will receive a full refund of the prepaid travel funds if the affiliated tour operator goes bankrupt unexpectedly.

Also, all member organizations are members of the ANVR, providing an additional guarantee that the tour operator meets all legal requirements. Of course, all member organizations also have corporate liability insurance. This insurance covers damage to persons and/or property and consequential damages should something unexpected happen during the trip. This way you know you can book a trip with one of the affiliated members with peace of mind!

For affiliated tour operators, membership in the Calamity Fund is mandatory. This guarantees that in case of a calamity, your tour operator will have to adjust the trip and then the necessary costs will be reimbursed. Does the organizer have to suspend the trip temporarily, or do you have to return home early? If so, you will receive a partial refund of the trip price.

Because of the above assurances, you can be sure that if you book a trip with an affiliated tour operator of “The Travel Club” you have found a reliable partner. In the unlikely event that something does go wrong with or during a trip and this is then not resolved according to your wishes, it is good to know that all members are affiliated with the Geschillencommissie Reizen.

INSURANCES

Bith theft or damage to your rental bike, you are personally liable. Stolen or damaged equipment must be reimbursed to the rental company. We recommend that for both rental bikes and your own bikes, you purchase travel insurance with additional hobby and sports equipment that protects you from these expenses.

EYE4CYCLING TRAVEL CONDITIONS

Op all trips in Eye4Cycling’s cycling vacation program, our Travel Terms and Conditions apply.

ARTICLE 1 INTRODUCTORY PROVISION

Article 1(1)

In these Travel Terms and Conditions, the following definitions shall apply:

a. travel organizer; the person who, in the course of his business, offers pre-arranged trips in his own name to the public or to a group of persons;

b. travel agreement; the agreement whereby a travel organizer undertakes to his counterparty to provide a pre-arranged trip offered by him that includes an overnight stay or a period of more than 24 hours as well as at least two of the following services: 1. transportation; 2. stay; 3. any other tourist service, not related to transport or accommodation, which is a significant part of the trip;

c. traveler; A. the travel organizer’s counterparty; or B. the person on whose behalf the travel has been stipulated and who has accepted that stipulation; or C. the person to whom, in accordance with Article 8 of these terms and conditions, the legal relationship to the travel organizer has been transferred.

d. booking office; the company that mediates between the traveler and the tour operator in concluding the travel contract.

e. working days; the days Monday through Friday, excluding recognized holidays;

f. office hours (excluding recognized holidays): Monday through Friday: 9 a.m. – 5 p.m.

Article 1(2)

These travel conditions apply to all travel agreements.The tour operator may stipulate that these travel conditions also apply to agreements relating to other travel, provided that this is stated in the publication.

Article 1(3)

The amounts stated in these terms and conditions are, where applicable, inclusive of VAT.

ARTICLE 2 FORMATION AND CONTENT OF AGREEMENT

Article 2(1)

The contract is established by the traveler’s acceptance of the tour operator’s offer. Acceptance may be made either directly or through the mediation of a booking agency.

After the conclusion of the agreement, the traveler will receive written or electronic confirmation thereof, possibly in the form of a (pro forma) invoice.

Article 2(2)

The tour operator’s offer is non-binding and may be revoked by it if necessary. Revocation should be made as soon as possible, but at the latest within 8 business hours after acceptance, giving reasons. Revocation for correction of errors in the fare calculation is permitted; revocation for increase in the fare must meet the requirements of Article 4.

Article 2(3)

The tour operator is entitled to cancel the agreement with immediate effect, if the number of applications is less than the required minimum number, stated in the publication. Notice of termination must be given within the period specified in the publication and in writing. Articles 10 and 12 do not apply.

Article 2(4)

a. The traveler shall provide the booking office or the tour operator before or no later than the conclusion of the agreement with all information concerning himself and the travelers he has registered that may be important for the conclusion or execution of the agreement. He shall also state details of the quality or composition of the group of travelers he has notified which may be important for the proper execution of the trip by the tour operator.

b. If he fails in this obligation to provide information and this results in the traveller(s) being excluded by the tour operator from (further) participation in the tour in accordance with the provisions of article 15, section 2, the costs referred to in that article will be charged to him.

Article 2(5)

a. The person who enters into an agreement in the name of or on behalf of another person (the notifier) is jointly and severally liable for all obligations under the agreement.

b. All traffic (including payment traffic) between the traveler(s), on the one hand, and the tour operator and/or booking office, on the other hand, is conducted exclusively through the registrant.

c. The (other) traveler(s) are liable for their own share.

Article 2(6)

a. If the agreed trip is included in a publication of the tour operator, the data contained therein shall also form part of the contract.

b. If the tour operator has included general reservations in the general part of the program and they conflict with the travel conditions, the provisions most favorable to the traveler shall apply.

c. Obvious errors and obvious mistakes do not bind the tour operator. Such errors and mistakes are errors and mistakes that – from the perspective of the average traveler – are or should be apparent as such at first glance.

Article 2(7)

Departures from or additions to the trip offered by the tour operator may be required on medical grounds (medical essences). The tour operator will make a genuine effort to comply with this, unless this cannot reasonably be required of him. Medical essences require the express written consent of the tour operator. In this case, the tour operator is entitled to charge the following costs:

a. organizational costs associated with the deviation or addition up to an amount of €35 per booking;

b. communication costs;

c. any additional costs charged by the service providers involved in the execution of the trip.

An essence request on other than medical grounds (other essences) will only be considered by the tour operator if it has a reasonable chance of success. In that case, he is entitled to charge the following fees:

a. the organizational costs associated with the request of €35 per booking;

b. communication costs;

c. any additional costs charged by the service providers involved in the execution of the trip. These requests also require the express written consent of the tour operator.

Article 2(8)

If, for trips where transportation is included, the duration of travel and stay is stated in days in the publication, the days of departure and arrival, regardless of the time of departure and arrival, are counted as whole days. This may in some cases result in the actual stay at the destination counting fewer days than stated in the publication.

Article 2(9)

For transportation elements of the trip, departure and arrival times will be provided in the travel documents. These times are final. The tour operator may deviate from this only within reasonable limits and only if maintaining these times cannot reasonably be required of him. In that case, Articles 11 and 12 do not apply.

Article 2(10)

The tour operator bears no responsibility for general information in photographs, leaflets, advertisements, websites and other information carriers, insofar as prepared or published under the responsibility of third parties.

ARTICLE 3 PAYMENT

Article 3(1)

Upon formation of the contract, booking fees and flight-related amounts must be paid in full. Flight-related amounts are: the cost of flights including all surcharges and taxes and transportation costs for taking bicycles.

Article 3(2)

The travel sum must be in the possession of the tour operator no later than 6 weeks before the day of departure, if the booking is covered by VZR Garant’s travel guarantee. Booking flights is not covered by the VZR travel guarantee.

In case of late payment, the traveler is in default. He will be notified of this in writing by or on behalf of the tour operator and will then still have the opportunity to pay the outstanding amount within 5 working days. If payment is not made even then, the agreement is deemed cancelled on the day of default. The tour operator is entitled to charge the cancellation fee due for this purpose. In this case, the provisions of Article 9 shall apply and the funds already paid shall be deducted from the cancellation fees.

Article 3(3)

If the contract is concluded within 6 weeks before the day of departure, the entire travel sum must be paid immediately.

ARTICLE 4 TRAVEL PRICE

Article 4(1)

The published travel price is per person. This includes the services and facilities listed in the publication. The published travel price does not include the contribution to VZR Garant, being €7.50 per participant per booking.

Article 4(2)

The published travel price is based on the prices, exchange rates, levies and taxes, as known to the tour operator at the time of printing the publication.

Article 4(3)

As long as the entire fare has not been paid, the tour operator has the right to increase the fare up to 20 days before the day of departure due to changes in transportation costs (including fuel costs), taxes, levies and applicable exchange rates. In doing so, the tour operator will indicate how the increase was calculated. Said changes will also give rise to a reduction in the fare, unless, in view of the costs involved, this cannot reasonably be required of the tour operator.

Article 4(4)

a. Charter air travel Europe After the formation of the travel agreement, the tour operator will, in deviation from the provisions of paragraph 3, not change the fare of charter air travel operated by Dutch airlines to European destinations and the Mediterranean countries.

b. Other travel After timely payment of the entire travel price, the tour operator will not change the travel price during the period starting six weeks before the day of departure (for self-drive travel before the arrival date of the first booked stay), in deviation from the provisions of paragraph 3.

c. Notwithstanding the sub a. and b. certain and only in case of unforeseeable A. increases in taxes or charges due; or B. extreme increase in transportation costs, the tour operator may increase the fare up to 20 days before the day of departure.

Article 4(5)

a. The traveler is entitled to reject an increase in the travel price as referred to in the two previous paragraphs. He must – under penalty of forfeiture – exercise this right within 3 working days of receiving notification of the increase.

b. If the traveler rejects the fare increase, the tour operator is entitled to cancel the contract. He must – under penalty of forfeiture – exercise this right within 7 working days of receipt by the traveler of the notice about the increase. If so, the traveler is entitled to remission or immediate refund of monies already paid. Articles 10, 11 and 12 do not apply.

ARTICLE 5 INFORMATION

Article 5(1)

General information regarding passports, visas and any health formalities will be provided to the traveler by or on behalf of the tour operator no later than the conclusion of the contract. The traveler himself will obtain the necessary additional information from the relevant authorities and also check in good time before departure that the information previously obtained has not changed in the meantime.

Article 5(2)

If the traveler cannot (completely) make the trip due to the absence of any (valid) document, this and all related consequences are for his account, unless the tour operator has promised to take care of that document and the absence thereof can be attributed to him or the tour operator has failed in his information obligation referred to in the previous paragraph.

Article 5(3)

The traveler must be in possession of the necessary documents at departure and during the trip, such as a valid passport, or, where permitted, an identity card and any required visas, proof of immunizations and vaccinations, driver’s license and green card.

Article 5(4)

Information will be provided to the traveler by or on behalf of the travel organizer regarding the possibility of cancellation and travel insurance.

ARTICLE 6 TRAVEL DOCUMENTS

Article 6(1)

The tour operator shall put the necessary travel documents in the possession of the traveler at least 10 days before the day of departure (for own-account travel before the arrival date of the first booked accommodation), unless this cannot reasonably be required of the tour operator.

Article 6(2)

If the traveler has not received travel documents by 5 working days before departure at the latest, he or she shall report this to the tour operator or booking office without delay. 4

Article 6(3)

a. In case a trip is booked within 10 days before the day of departure (for own-account travel: before the arrival date of the first booked accommodation), the tour operator or booking office will indicate when and how the necessary travel documents will be put in the possession of the traveler.

b. If the traveler has not received it accordingly, he shall immediately report it to the tour operator or booking office.

Article 7 CHANGES BY THE TRAVELER

Article 7(1)

a. After the conclusion of the agreement, the traveler may request its modification. Up to 28 days before departure (in the case of own-account travel before the arrival date of the first booked stay), these changes will be made to the extent possible and in this case confirmed in writing by the tour operator. This is subject to the condition, that the traveler pays the modified travel price minus monies already paid.

b. In addition, he is obliged to reimburse the modification costs of €35 per booking and any communication costs.

c. Postponement of the departure date or reduction in the number of paying passengers is considered a (partial) cancellation to which Article 9 applies. In that case, no modification or communication fees are due.

Article 7(2)

a. The request will be decided on as soon as possible. Rejection will be reasoned and communicated to the traveler without delay. The traveler may maintain or cancel the original agreement. In the latter case, Article 9 applies.

b. In the absence of a response from the traveler to the rejection of his request, the original contract will be executed.

ARTICLE 8 SUBSTITUTION

Article 8(1)

In good time before the start of the trip, the traveler may be replaced by another person. The following conditions apply:

a. the other meets all conditions attached to the agreement, and

b. the request is submitted no later than 7 days before departure, or in sufficient time to allow the necessary acts and formalities to be completed, and

c. the conditions of the service providers involved in the implementation do not oppose this substitution.

Article 8(2)

The notifier, the traveller and the person who replaces him are jointly and severally liable to the tour operator for payment of the part of the fare still due, the alteration and communication costs referred to in Article 7, Paragraph 1 and any additional costs resulting from the replacement.

Article 9 CANCELLATION BY THE TRAVELER.

Article 9(1)

Trips, for which a Calamity Fund Travel coverage restriction applies, can be cancelled free of charge from 30 days prior to departure.

Article 9 paragraph 2a

If a flight is included in the trip then the following amounts are due upon cancellation by the traveler:

a. for cancellation up to the 42nd day (exclusive) before the departure day: the cancellation fee of the flight + 25% of the travel sum;

b. for cancellation from the 42nd day (inclusive) to the 28th day (exclusive) before the day of departure: the cancellation fee of the flight + 50% of the travel sum;

c. for cancellation from the 28th day (inclusive) to the 21st day (exclusive) before the departure day: the cancellation fee for the flight + 55% of the travel sum;

d. for cancellation from the 21st day (inclusive) to the 14th day (exclusive) before the day of departure: the cancellation costs of the flight + 65% of the travel sum;

e. for cancellation from the 14th day (inclusive) to the 5th day (exclusive) before the departure day: the cancellation fee for the flight + 90% of the travel sum;

f. for cancellation from the 5th day (inclusive) to the day of departure or later: the full travel sum.

Article 9 paragraph 2b

If a contract is cancelled, the traveler shall owe the following cancellation fees in addition to any reservation fees due:

a. for cancellation up to the 42nd day (exclusive) before the departure day: 25% of the travel sum;

b. for cancellation from the 42nd day (inclusive) to the 28th day (exclusive) before the day of departure: 50% of the travel sum;

c. for cancellation from the 28th day (inclusive) to the 21st day (exclusive) before the departure day: 55% of the travel sum;

d. for cancellation from the 21st day (inclusive) to the 14th day (exclusive) before the day of departure: 65% of the travel sum;

e. for cancellation from the 14th day (inclusive) to the 5th day (exclusive) before the day of departure: 90% of the travel sum;

f. for cancellation from the 5th day (inclusive) to the day of departure or later: the full travel sum.

Article 9(3)

a. If a trip is composed of different components, to which different cancellation provisions apply, the provisions specifically applicable to each component apply.

b. Organizers of cruises, tours, adventure travel and travel outside Europe and the Mediterranean countries may derogate from the provisions of paragraph 2. They make this known to the traveler in advance.

c. If transportation is performed by scheduled service or special services such as camper rental, car rental, national parks and cultural or sporting events are offered, different cancellation provisions may apply to such transportation or special services. These will be made known to the traveler in advance.

Article 9(4)

The traveler who cancels the trip is obliged to pay the cancellation fee in accordance with the provisions of the previous paragraphs, unless he gives reasons why the tour operator’s damages are lower. In that case, the tour operator will charge this lower damage. Damage means losses suffered and lost profits.

Article 9(5)

In case no cancellation occurs, but the traveler chooses substitution, article 8 applies.

Article 9(6)

a. Cancellation of a contract by one or more travelers who have jointly booked for a stay in a hotel room, apartment, vacation home or other accommodation shall be considered cancellation of all contracts, so that the amounts referred to in previous paragraphs must be paid by all travelers.

b. If the remaining travelers so desire and their group size appears in the price table for this accommodation, the respective agreements will remain in place. The provisions of subsection c shall then apply.

c. The travelers referred to in subsection b will have to pay the fare as stated in the price table for the remaining number of travelers.

d. If the remaining travelers wish to enter into a new contract for the same time period and accommodation, the cancellation fees received for the remaining traveler(s) will be deducted from the new fare(s).

By the way, the total amount of cancellation fee and increased travel price(s) will never exceed the total of travel prices for the original travelers.

Article 9(7)

Cancellations outside business hours are considered to be made on the next business day.

ARTICLE 10 CANCELLATION BY THE TOUR OPERATOR

Article 10(1)

Eye4Cycling may cancel the agreement before the trip begins and refund to the traveler all amounts paid for the trip without being liable for compensation:

(a) if the number of registrations is less than the minimum number specified in the Agreement and the traveler is notified of the cancellation within the period specified in the Agreement, but no later than:
20 days prior to the start of the Trip for a Trip of 6 days or more.
7 days before the start of the Trip for a Trip of 2 to 6 days.
48 hours before the start of the Trip for a Trip of less than 2 days.
(b) in the event of force majeure, which is defined as unavoidable and extraordinary circumstances.
Article 10(2)

Refund of travel price paid

In the above cases, Eye4Cycling shall refund any amounts already received without delay and at the latest within 14 days. Not reimbursed are costs incurred by the traveler for services outside the agreement such as vaccinations, visas, purchase of materials, insurances and if not included in the trip, air travel, tickets, accommodation, etc.

Article 10(3)

The tour operator has the right to cancel the contract due to serious circumstances. Substantial circumstances are defined as circumstances of such a nature that further binding of the tour operator to the contract cannot reasonably be required.

Circumstances shall mean circumstances Article 10, paragraph 4

A contract-related coverage limitation of the Travel Calamity Fund is a major circumstance.

Article 10(4)

If the cause of the cancellation can be attributed to the traveler, the resulting damage shall be borne by the traveler.
If the cause of the cancellation can be attributed to the tour operator, the resulting damage shall be borne by the tour operator. Whether such is the case shall be determined by reference to Article 12.
If the cause of the cancellation cannot be attributed to either the traveler or the tour operator, the parties shall each bear their own damages as detailed in Article 13.
Article 10(5)

If the tour operator saves money by the cancellation, the traveler is entitled to the amount of that saving for his part.

ARTICLE 11 MODIFICATION BY THE TOUR OPERATOR

Article 11(1)

a. The tour operator is entitled to change the agreed service on one or more essential points due to important circumstances as further described in Article 10, paragraph 2. It shall notify the traveler within 72 hours (3 working days). As of 10 days before departure (for own-haul trips before the arrival date of the first booked stay), he will notify them within 24 hours (1 business day).

b. The traveler may reject the change(s).

c. If the cause of the change is attributable to the traveler, the resulting damage shall be borne by the traveler.

d. If the cause of the change is attributable to the tour operator, the resulting damage shall be borne by the tour operator. Whether such is the case shall be determined by reference to Article 12.

e. If the cause of the change cannot be attributed to either the traveler or the tour operator, the parties shall each bear their own damages as detailed in Article 13.

f. If the tour operator saves money due to the change, the traveler is entitled to the amount of that saving for his part.

Article 11(2)

In case of change, the tour operator shall make the traveler an alternative offer if possible. It does so within 72 hours (3 business days). From 10 days before departure (for own-account travel before the arrival date of the first booked stay) a deadline of 24 hours (1 working day) applies for this.

Article 11(3)

The alternative offer must be at least equivalent. The equivalency of alternative accommodation must be judged by objective standards and should be determined according to the following circumstances that must be evident from the substitute offer:

1. the location of the accommodation in the venue;

2. the nature and class of the accommodation;

3. the facilities further offered by the accommodation.

The assessment referred to above should take into account:

1. the composition of the travel party;

2. the special characteristics of the traveler(s) concerned known to the tour operator and confirmed by him in writing;

3. the deviations from the program or additions to it required by the traveler, which have been confirmed in writing by the tour operator for agreement;

4. personal circumstances made known at the time of registration and recorded thereby, which are declared by the traveler(s) as being of essential importance.

Article 11(4)

If the tour operator’s offer referred to in paragraph 2 is rejected by the traveler or no such offer is made, paragraph 6 shall apply.

Article 11(5)

The tour operator may also amend the contract in a non-essential point due to important circumstances communicated to the traveler without delay. In such a case, the traveler may reject the change only if the change causes him more than minor inconvenience.

Article 11(6)

a. The traveler who exercises his right to reject the change or alternative offer pursuant to the previous paragraphs must make this known within 72 hours (3 business days) of receiving notice of the change. From 10 days before departure (for own-account travel before the arrival date of the first booked stay) a deadline of 24 hours (1 working day) applies for this.

b. In this case, the tour operator has the right to cancel the contract with immediate effect. He must – on pain of forfeiture – exercise this right within 72 hours (3 working days) of receipt of notification of the change by the traveler. From 10 days before departure (for own-account travel before the arrival date of the first booked stay) a deadline of 24 hours (1 working day) applies for this.

The traveler shall in that case be entitled to remission or restitution of the travel sum (or, if the trip has already been partially enjoyed, to restitution of a proportionate part thereof) within 2 weeks, without prejudice to his possible right to compensation as referred to in paragraph 7 of this article.

Article 11(7)

In the event of cancellation pursuant to the previous paragraph, the tour operator shall compensate the traveller for the damage suffered by him, unless the cancellation is the result of force majeure as referred to in article 12, section 4, which does not include overbooking.

Article 11(8)

a. If, after the departure of the traveler(s), a significant part of the services, to which the contract relates, is not provided or the tour operator perceives that it will not be able to provide a significant part of the services, the tour operator shall ensure that appropriate, alternative arrangements are made for the continuation of the trip.

b. If such arrangements are impossible or are not accepted by the traveler(s) for sound reasons, the tour operator shall provide the traveler(s) with an equivalent means of transport, which will bring him/her back to the place of departure or another place of return agreed upon with the traveler(s).

c. The damage to the traveler resulting from this change shall be borne by the tour operator, if the failure to perform the contract is attributable to him in accordance with the provisions of Article 12.

Article 11(9)

The tour operator is, without prejudice to the provisions of Article 15, part 1, obliged to inform the traveller of a change in departure time implemented by him. With regard to the return journey, this obligation does not apply to travellers who have booked exclusively for transport and/or whose accommodation address is not known. 7

ARTICLE 12 LIABILITY AND FORCE MAJEURE

Article 12(1)

Without prejudice to the provisions of Articles 10, 11, 13, 14 and 15, the tour operator is obliged to execute the agreement in accordance with the expectations that the traveler could reasonably have on the basis of the agreement.

The tour operator is affiliated with VZR Garant. VZR Garant guarantees that you will be refunded the portion of your travel price already paid if the travel company becomes financially insolvent. This may be before your departure but also during your stay on site. Moreover, during your stay, VZR Garant guarantees your return trip if, due to financial insolvency, the tour operator can no longer provide it.

Article 12(2)

If the trip does not go according to the expectations referred to in paragraph 1, the traveler is obliged to notify the parties involved as referred to in Article 17 paragraphs 1 and 2 as soon as possible.

Article 12(3)

If the trip does not turn out in accordance with the expectations referred to in paragraph 1, the tour operator is obliged to compensate any damages, unless the failure to perform is not attributable to him or to the person whose assistance he uses in the performance of the contract, because:

a. the failure to perform the contract is attributable to the traveler; or

b. the failure in the performance of the contract could not be foreseen or could not be eliminated and is attributable to a third party not involved in the provision of the services included in the trip; or

c. the failure in the performance of the contract is due to an event which the tour operator or the person whose assistance he uses in the performance of the contract could not, with all due care, foresee or remedy; or

d. the failure to perform the agreement is due to force majeure as referred to in paragraph 4 of this article.

Article 12(4)

Force majeure is defined as abnormal and unforeseeable circumstances independent of the will of the person invoking it, the consequences of which could not be avoided despite all precautions.

ARTICLE 13 AID AND ASSISTANCE

Article 13(1)

a. Depending on the circumstances, the tour operator is obliged to provide the traveler with help and assistance if the trip does not proceed in accordance with the expectations that the traveler could reasonably have under the contract. The resulting costs shall be borne by the tour operator, if the failure to perform the contract is attributable to him in accordance with the third paragraph of Article 12.

b. If the cause is attributable to the traveler, the tour operator is only obliged to provide help and assistance to the extent that it can reasonably be required of him. In that case, the costs will be borne by the traveler.

Article 13(2)

If the trip does not proceed in accordance with the expectations that the traveler could reasonably have under the contract due to circumstances that are not attributable to either the traveler or the tour operator, each shall bear their own losses. For the travel organizer, it consists, among other things, of the additional deployment of manpower: for the traveler, it consists, among other things, of additional accommodation and repatriation costs.

ARTICLE 14 LIABILITY, DAMAGES & EXONERATION

Article 14(1)

Compensation includes damages suffered as well as compensation for lost travel enjoyment.

Article 14(2)

Attribution and force majeure

The traveler shall in no case be entitled to compensation for damages incurred by the traveler as a result of non-conformity, insofar as the non-conformity is due to:

the traveler;

third parties not directly involved in the performance of the contract and the nonconformity could not be foreseen or prevented;

unavoidable and extraordinary circumstances.

Article 14(3)

Liability exclusion

Any liability of Eye4Cycling for damages shall be limited to three times the trip price unless the damages result from the death or personal injury of the traveler or the damages are caused by intentional or negligent acts of Eye4Cycling.

Article 14(4)

Liability exclusion under treaty or EU regulation

If Eye4Cycling can be held liable for any damages, including damages resulting from the death or personal injury of the traveler, such liability shall in any case be limited or excluded to the limits permitted under the relevant international conventions and/or EU regulations applicable to the individual travel services.

Article 14(5)

Insured loss

Eye4Cycling is not liable for any damages incurred by the traveler that are covered by insurance, such as health, travel or cancellation insurance.

Article 14(6)

Statute of limitations

Any claim of the traveler for compensation for damages shall expire two years after the trip took place or if the trip did not take place two years after the scheduled date of commencement.

Article 14(7)

No accumulation of fees

If, because of the same event, compensation or damages are due under international conventions or EU regulations, such as the Regulation on Air Passenger Rights in the event of denied boarding, cancellation or long delay, such compensation or damages shall not accumulate with the compensation or price reduction under this Agreement. The compensation or damages shall be deducted from the compensation or price reduction owed by Eye4Cycling under this Agreement. For the above purposes, it does not matter whether compensation or damages under international conventions or EU regulations are payable by Eye4Cycling or any travel service provider it engages.

ARTICLE 15 OBLIGATIONS OF THE TRAVELER

Article 15(1)

a. The traveler(s) is/are obliged to comply with all instructions of the tour operator to promote the proper execution of the trip and is/are liable for damages caused by his/her/their improper conduct, to be judged by the standard of conduct of a proper traveler.

b. Each traveler must ascertain the exact departure time of the return trip from the tour guide or the tour operator’s local agent at least 24 hours before the specified departure time.

Article 15(2)

a. The traveler who causes or may cause such a nuisance or inconvenience that the proper execution of a trip is or may be greatly hindered as a result, may be excluded from (continuation of) the trip by the tour operator, if the latter cannot reasonably be required to fulfill the contract.

b. All resulting costs shall be borne by the traveler, if and to the extent that the consequences of nuisance or trouble may be attributed to him. If and insofar as the cause of the exclusion cannot be attributed to the traveler, he shall be granted a refund of the travel price or part thereof.

Article 15(3)

The traveler is obliged to avoid or limit any damage as much as possible, in particular by fulfilling his reporting obligation as further described in Article 17 paragraphs 1 and 2.

Article 15(4)

All traveler’s rights of action expire one year after the trip (or, if the trip did not go ahead, one year after the original departure date).

ARTICLE 16 INTEREST AND COLLECTION COSTS

The traveler who has not fulfilled a monetary obligation to the tour operator in time shall owe statutory interest on the amount still due. He shall further be liable to pay extrajudicial collection costs equal to 15% of the amount claimed, unless this amount, taking into account the collection work and the amount due, is unfair.

ARTICLE 17 COMPLAINTS

Article 17(1)

a. A detected shortcoming in the performance of the agreement referred to in Article 12, paragraph 2, must be reported to the service provider concerned as soon as possible, so that it can provide an appropriate solution. If the deficiency is not resolved and detracts from the quality of the trip, it must be reported to the tour guide without delay.

b. If it is not present or accessible, the traveler should contact the tour operator immediately in the manner prescribed by the tour operator.

c. The communication costs will be reimbursed by the tour operator, unless it turns out, that they reasonably should not have been incurred.

d. If it subsequently transpires that the traveller has not fulfilled this reporting obligation and the tour operator was consequently not given the opportunity to remedy the defect, his possible right to compensation for damages may be limited or excluded accordingly.

Article 17(2)

a. If even then the shortcoming is not satisfactorily resolved and gives rise to a complaint, the traveler must report it as soon as possible in writing to the tour guide (complaint report) or, if this is impossible, to the tour operator in the manner prescribed by the tour operator.

b. If it subsequently transpires that the traveller has not fulfilled this reporting obligation and the tour operator was consequently not given the opportunity to remedy the defect, his possible right to compensation for damages may be limited or excluded accordingly.

c. If a complaint is not satisfactorily resolved, it must be submitted to the tour operator or booking office in writing, stating reasons, no later than one month after the end of the trip or service enjoyed (or after the original departure date).

d. If the complaint does not concern the execution but the realization of an agreement, it should be submitted to the booking office within one month after the traveler became aware of the facts, to which the complaint relates.

e. If the traveler has not submitted the complaint in a timely manner, it will not be processed by the tour operator, unless the traveler cannot reasonably be blamed for this. The tour operator shall notify the traveler in writing or electronically.

Package prices listed are based on prices per person, based on 2 people staying in 1 room.
Most rooms these days are double rooms. The supplement for 1 person in a room varies by destination and is listed with the respective trip.

No later than 6 weeks before departure, the total travel sum must be paid. You will receive the invoice via e-mail. If you book within 6 weeks before the departure date, we expect payment as soon as possible.

LO stands for an overnight stay with breakfast (bed and breakfast). HP is accommodation on a half-board basis (breakfast and dinner).

Yes you can choose to have your luggage transported by us. If you choose to carry the luggage yourself during the trip, the fare will be lower.
For each trip, you’ll see what’s included, and what items you can add.

Yes, this is possible, however, only based on availability.
You will receive the bill via email, we kindly ask you to pay it on the day of booking.

Before the trip begins, you will receive the following documents:

We favor the use of GPS navigation. All cycling routes are available in GPX format. If you do not have your own GPS navigation, you can rent it from us.

If you rent a navigation device from us, you will receive a simple explanation with it.
All our navigation equipment is of the well-known brand Garmin, very user-friendly and easy to operate.

During group tours, wearing a helmet is mandatory. Macedonia and Spain have helmet requirements. On individual trips, it is up to the participant to wear a helmet.

We always recommend wearing a helmet for safety reasons.

Basically, you are supposed to book the airline tickets yourself. This can be done very easily over the Internet these days.

Eye4Cycling is a Dutch company, registered with the Chamber of Commerce, and affiliated with the Association of Small-scale Travel Organizations (VVKR).
This organization can be compared to the ANVR, only it focuses on small-scale travel organizations and represents the interests of its affiliated members.

We are also affiliated with the Guarantee Fund for Specialized Tour Operators (GGTO). Per booking you pay €15.00 to the guarantee fund.

A Dutch or English speaking contact person is present during all our cycling vacations.

On the group tours, there is always a fellow cycling Dutch tour guide present. During the group tours in Turkey, Macedonia and northern Greece, there is always a support vehicle present that rides along the entire route.

Our cycling tours generally have a fixed trip duration, but it is certainly possible to customize it. Eye4Cycling specializes in custom trips so that your needs can be taken into account.

Yes, at all travel destinations you can choose a 1-bedroom, based on availability.

When a hotel room is used by 1 person, a surcharge does apply. You can find the amount of this surcharge in the information of each cycling vacation on our website.

Yes this is possible, provided that another person (of the same sex) has indicated a desire to share a room. This is also called a room by layout.

Should no other participant be available, the single supplement will be charged.

You will stay, with the exception of one location destination, in small-scale hotels and are characterized by their own personal atmosphere with friendly and helpful staff. The quality of the accommodations ranges from simple to luxurious but, above all, contain proper value for money.

Questions about rental bikes

Of course, you are free to bring your own bike. Please note; you must provide your own transportation for your bicycle to the travel destination. For the use of your own bike we charge a surcharge of € 40.00 per bike.

In all travel destinations, however, we have quality and well-maintained rental bikes. We recommend using a rental bike.

You will receive a discount on the package price if you choose to carry the luggage yourself on an individual cycling vacation. However, this discount varies by travel destination.

When the rental bike is issued, you will receive the following materials:

  • lock
  • bicycle pump
  • spare tire
  • toolkit
  • repair kit

Bike bags are also available at some destinations; you can reserve them in advance and pay for them on site.

We would like to receive your height measurement before the start of the cycling vacation so that we can provide the right bike.

The bike rental company may charge you a deposit. However, you remain entirely responsible for the bicycle during the rental period. So make sure the bike is always locked when you leave it.

Information regarding travel and coronavirus

UPDATE: July 26, 2021 – 2 p.m.

From Tuesday, all EU countries green or yellow

As of Tuesday, July 26, travel to any EU country is no longer advised against and all countries in the European Union are given a yellow or green travel advisory. A country turns orange again only when a dangerous virus mutant turns up there.

The government advises all travelers returning from abroad to get themselves tested. For those who are not fully vaccinated or do not have a corona recovery certificate, the “urgent advice” is to test themselves on the day after return and on the fifth day in the Netherlands. This may be a self-test, or it may be free at the GGD.

Information regarding travel and coronavirus

UPDATE: MARCH 24, 2021 – 2 P.M.

Eye4Cycling is closely monitoring developments related to coronavirus (COVID-19). We follow the information from RIVM and the advice of the Ministry of Foreign Affairs. We also have close contact with the Foundation Guarantee Fund for Specialized Tour Operators (GGTO) and the Association of Small-scale Travel Organizations (VvKR).

General

The unease and sometimes uncertainty surrounding the coronavirus and travel is still high, which is why we as Eye4Cycling are providing an update with the state of affairs, as far as we are aware at this time.
As Eye4Cycling, we continually monitor developments and are in direct contact with airlines, local suppliers, hotels and the like to update ourselves on the situation for the destination in question.

The State Department provides travel advice for each country, which is obviously followed by Eye4Cycling. There are four color codes, namely:


green
: no specifics, but go on vacation well prepared and check the websites of the State Department, for example;


yellow
: there are security risks, local authorities may have taken (socially) restrictive measures;


orange
: travel only when necessary;


red
: do not travel.

In the press conference on March 23, 2021, the prime minister informed that we will not be allowed to travel abroad until May 15, 2021.
However, there is light at the end of the tunnel now that vaccination seems to be really well underway.
Hopefully we can give you a better picture after the next press conference about the possibilities regarding our trips abroad.

Foreign vacations with a departure date until May 15, 2021

Regarding foreign vacations (travel), the prime minister told us that the negative travel advisory has been extended until May 15, 2021. Specifically, at the moment, this means that foreign vacations cannot be carried out in any case due to corona measures.

Cancellation by Eye4Cycling.

If your vacation is cancelled by Eye4Cycling due to corona measures (for example, a code orange or red travel advisory), you will receive a refund of the amount paid within 14 days. In 2021, we will not work with travel vouchers.

If you received a travel voucher from Eye4Cycling in 2020

Unfortunately, due to special circumstances last year, many trips could not be made and you may have received a travel voucher from Eye4Cycling. If you are unable or unwilling to book a vacation this year and would prefer to receive a refund, we kindly ask you to send this request by e-mail to raymond@eye4cycling.com. You will then receive an acknowledgement of receipt and we will process your request in order of receipt (and taking into account the issue date).

Additional note 1

Should you wish to use the travel voucher to book a new vacation and the new vacation is cheaper, you will of course receive the difference back. If the vacation has a higher travel price, you must pay the difference.

Additional note 2

If you have reserved a vacation but have not yet made your deposit, this does not mean that you therefore do not have to pay and/or can cancel free of charge. The payment obligation you entered into with the conclusion of the travel contract remains in effect.

Additional note 3

Vacations that have code yellow as the destination travel advisory will go ahead and for these reservations the normal payment conditions as stated on the travel contract/confirmation/invoice will apply.
